Question: I work in customer service. Is it assault if my general manager waves his finger while screaming at me? My manager did not like how i was doing a task. So he asked me if i did it that way all the time. So i said yes, maybe with an attitude. The he comes towards me waving his finger yelling. Is it assault?

However, the GA code defines assault as: A person commits the offense of simple assault when he/she either 1) attempts to commit a violent injury to the person of another; or 2) commits an act which places another in reasonable apprehension of immediately receiving a violent injury. When you manager waved his finger did you feel that you were about to receive a violent injury? If so did you call the police when this happened? Your manager did not touch you, so its probably not an assault.
