REAL QUESTION:

What’s the purpose of the 90 day indictment? How does it work?  My husband been in jail for two months now for the sale of marijuana and only evidence they have is him on audio they don’t have the money or the weed they picked him up 4 months later after he’s charged with sale of marijuana.. we do have a criminal defense only thing we are waiting on is his revocation hearing. He’s on a felony probation for 10 years…can someone tell me what’s gonna happen here?

REAL ATTORNEY RESPONSE:

Hiring counsel would be best because in addition to the new allegations, your husband will have to address the probation revocation as well. As far as the new allegations, the case probably hadn’t been indicted yet, but that doesn’t mean that it won’t. Hire counsel or apply for a public defender to help you sort through this.
