Law Q & A, “I beat up a burglar, now he wants to sue”

1)     Question: Can a burglar sue me for physically beating them after finding them in my home?

Question Detail: Ok, keeping this short and to the point, A man broke into my house about 3 weeks ago. It was roughly 3 am when the breaking in occurred. Now I’m a big man, physically big, and I will protect my home and those in it. So when I heard some noise from downstairs, and found this man rooting through MY belongings, I naturally sort of beat the living pulp out of him. The police were called after he was layed out on the floor, and he was detained and taken to jail. The police showed up recently to tell me that the burglar is suing me or pressing charges because i bruised him up real good. Is it legal for the BURGLAR to sue the person he tried to rob?

 

 

A person can attempt to sue someone based on allegations.  It appears that the burglar is alleging that you battered him.  Battery is when one intentionally makes physical contact of an insulting or provoking nature with the person of another, or intentionally causes physical harm to another.  Your defense to these allegations can be justification because he broke into your home, and/or defense of others because you were protecting your family.  If you have any other questions or concerns, feel free to call us at 1-888-917-8387.
